一、亞馬遜平臺(tái)會(huì)涉及到的侵權(quán)有哪些?
1. 版權(quán):侵犯版權(quán),通常指侵犯作者的著作權(quán)。這類侵權(quán),中國(guó)賣(mài)家還是比較少碰到。
2. 商標(biāo)權(quán):未得到產(chǎn)品品牌官方的正規(guī)授權(quán),擅自使用對(duì)方的商標(biāo)或LOGO。
3. 發(fā)明專利權(quán):如果出售的產(chǎn)品是別人發(fā)明的,而且別人申請(qǐng)了專利保護(hù),賣(mài)家未經(jīng)允許擅自生產(chǎn)銷售,也就是指銷售仿品。
4. 外觀設(shè)計(jì)專利權(quán):是指對(duì)產(chǎn)品的形狀、圖案、色彩或者其結(jié)合所做出的富有美感并適于工業(yè)上應(yīng)用的新設(shè)計(jì)。外觀設(shè)計(jì)是指工業(yè)品的外觀設(shè)計(jì),也就是工業(yè)品的式樣。外觀專利有60%以上相似就視為侵權(quán)假貨
二、亞馬遜產(chǎn)品侵權(quán)申訴要點(diǎn):
1.第一時(shí)間下架侵權(quán)產(chǎn)品不要抱有僥幸心理,并檢測(cè)整個(gè)店鋪是否有類似產(chǎn)品全部下架。
2.聯(lián)系郵件中給出的投訴者,承認(rèn)錯(cuò)誤無(wú)心之失,言辭懇求,告知已經(jīng)下架產(chǎn)品承諾不再銷售他們品牌的產(chǎn)品并抄送給亞馬遜notice郵箱。
3.申訴信:

1. Since we got the Warning Notice of Intellectual Property Rights Infringement about our ASIN: 侵權(quán)的ASIN碼 may infringe the intellectual property rights of others, we have remove all the inventory stop selling at first time, now we have deleted this listing now and we no longer sell it again.
2. We have contact the rights owner for retracting the complaints and made the most sincere words of apology, but we haven’t received any responded up until now, we will closely watch the reply.
About this issue, we have taken the following steps to help us to resolve the issue and prevent similar complaints.
1. We have checked all the listing detail from title, image, description and bullet point to ensure have no information in misunderstanding. And we are firmly deleting all the listings that could show any signs of conflicts with intellectual property rights.
2. We have establish the professional handling team to take care of listing 100% match on description, images, bullet points, & search terms, etc. Never make more mistakes of the Product Design or Brand.
3. We have organized our own research department to make sure we can sell our own products with our own design & model instead of purchasing from our supplier, to prevent any possible infringement problems on Trademarks & Packages & Design.

三、如何避免亞馬遜產(chǎn)品侵權(quán)?
1.保證供貨渠道的正規(guī)性,在進(jìn)行選品之時(shí),就要從貨源供應(yīng)鏈上防止產(chǎn)品可能存在的侵權(quán)問(wèn)題。了解生產(chǎn)商/供貨商的生產(chǎn)能力,生產(chǎn)資質(zhì),杜絕仿品、假貨。如果發(fā)現(xiàn)某個(gè)產(chǎn)品上面印有別人家的商標(biāo),最好先在商標(biāo)網(wǎng)站上進(jìn)行查詢,一旦發(fā)現(xiàn)商標(biāo)有效,而同時(shí)商標(biāo)主體并不是你的供應(yīng)商,供應(yīng)商也無(wú)法給你提供授權(quán)書(shū),此時(shí),建議不要銷售該產(chǎn)品。
2.賣(mài)家作為代理商,在亞馬遜上銷售某個(gè)品牌的產(chǎn)品,在刊登listing之前就需要先取得品牌商標(biāo)的正規(guī)授權(quán)。需要注意的是,只有商標(biāo)持有人才有資格進(jìn)行品牌授權(quán),一些代理商,是沒(méi)有資質(zhì)給其他在亞馬遜開(kāi)店的賣(mài)家授權(quán)的,只有取得了商標(biāo)持有者的正規(guī)授權(quán),賣(mài)家才有合法使用商標(biāo)權(quán)。
3.刊登listing時(shí),建議使用原創(chuàng)類圖片、文字描述。Listing的標(biāo)題、還有Search terms里面的關(guān)鍵詞,也不能帶有他人的品牌名稱。
4. 設(shè)置店鋪名時(shí),需要注意店鋪名中是否有涉及他人注冊(cè)的商標(biāo)。不能復(fù)制其它知名品牌名稱,也不能打擦邊球使用容易誤導(dǎo)買(mǎi)家的品牌名稱。
三、賣(mài)家收到侵權(quán)以后應(yīng)該怎么成功申訴?
1、首先審視自己是否侵權(quán),如果確實(shí)沒(méi)有侵權(quán),或者有授權(quán)書(shū),可以直接與亞馬遜官方溝通,提供相關(guān)證據(jù),證明自己。
2、查清楚對(duì)方的商標(biāo)專利申請(qǐng)情況,如果對(duì)方提供了專利詳情,確認(rèn)產(chǎn)品侵權(quán),這種情況的話直接下架listing, 并且積極和投訴方溝通,看是否可以通過(guò)簽訂保證書(shū)或者給一些賠償金,讓其撤訴。如果對(duì)方要求的賠償金較多,賣(mài)家可以去審視一下自己的賬號(hào)是否值得挽救回來(lái),或者也可以請(qǐng)知識(shí)產(chǎn)權(quán)律師代為溝通。
3、如果平臺(tái)直接下架了listing,聯(lián)系對(duì)方拒絕提供專利詳情,這種情況可以聯(lián)系平臺(tái)告知說(shuō)對(duì)方可能是惡意騷擾,拒絕提供任何的侵權(quán)證明,要求平臺(tái)恢復(fù)銷售權(quán)限。
